Rhode Island Lawmaker Introduces Bill to Fine Fake Service Animal Owners

Lawmakers in the United States are doubling their efforts to mitigate the rise of fake service animals. Recently, Rhode Island Rep. Thomas Winfield introduces legislation that addresses this misrepresentation of service animals. He proposes that violators of the law be fined up to $500 and required to do community service for up to 30 hours.

The restaurant and hospitality industry made this request which compelled Winfield to take action. Winfield says that this abuse of the use of service animals puts abiders of the law and true service animals at a disadvantage. The goal of Winfield’s bill is to protect the welfare of service animals so that people and establishments wouldn’t doubt their authenticity.

Representative Winfield owns a therapy dog himself. The dog, named Buddy, helps comfort families in Winfield’s funeral home.

Minister of Canadian Heritage Finds Joy in the Company of a Service Dog

Naboo is a Labrador retriever/Bernese mountain dog who is about to undergo training as a service dog. While waiting, she accompanies Mélanie Joly, the minister of Canadian heritage. Joly met Naboo through a friend who fosters MIRA Foundation service dogs but cannot handle one more dog alone – Naboo.

Joly faced several challenges – not to mention, serial criticism because of the logistical mess of a Canada 150 event on Parliament Hill and the issue on Nextflix’s tax exemption. Naboo’s companionship served as a great stress reliever for Joly. He followers her to meetings and created structure in her daily routine despite the hectic life of politics. Joly says that she has to feed Naboo at 8 a.m. and 8 p.m. walk him before and after meals. Though gym workouts are a stress reliever, Joly attests that having a pet around calms her more.

Joly knows that she’s going to lose Naboo soon when he turns into a service dog. But if Naboo doesn’t pass, Joly still has the option to buy him at half the price of being a service dog – that’s about $4,475.

Let’s put aside the rumors regarding the abuse of the use assistance animals and recall why they came into existence in the first place. Despite today’s climate of skepticism, it’s undeniable that service animals perform special tasks for their owners. Service animals are animals that are trained to help people affected with some form of disability. For example, a service animal owner can be at risk for collapsing but this can be prevented with the intervention of the animal.

This week, we heard of a report about a service dog that helped her owner for years in detecting drops in her blood pressure. The trained cardiac alert service dog is named Adele, a black labrador. Her owner, Marty Harris, is diagnosed with acute malignant neurocardiogenic vasovagal syncope. She faints many times because of this heart ailment and incurred many concussions. To make things worse, Harris was told by the doctor that there’s nothing much that can be done for her.

Canine Partners for Life, a non-profit organization that matches service dogs to disabled individuals, helped Harris by giving her Adele. Adele has a keen sense of smell that detects changes in Harris’ blood pressure and prompts Harris to sit down before she collapses. There was even a time when Adele caught Harris’ head using her torso to prevent it from hitting the ground. Harris said that since Adele came, she fainted only twice in 9 years.

This is just one of the many stories that show how meaningful service animals are.

Making Reasonable Accommodations for Emotional Support Animals

You’ve probably heard about emotional support animals. Emotional support animals such as dogs provide companionship and comfort to people who are suffering from mental and emotional conditions. Examples of these conditions are PTSD, depression, anxiety, and bipolar disorder. Making great companions, emotional support animals assist psychologically disabled individuals so they can live a fuller, more meaningful life.

Take note that emotional support animals can be any type of animal. What matters is that adopting this animal won’t violate local or state laws.

Over the last five years, there has been an increase in the number of requests to bring along emotional support animals in facilities, including those that have a “no pet policy.” These include condominiums, rental housing, and universities. After all, the Fair Housing Amendments Act (FHAA) prohibits any form of discrimination against emotional support animals and their owners.

Now that more requests are being made to accommodate ESAs, it’s important that property managers know how to address these requests. Denial of these legitimate requests can lead to legal consequences.

The Process of Making a Request to Grant an Accommodation

As mentioned earlier, your emotional support animal has the right to live with you even in a housing or building that has a “no pets” policy. The first step to living in a housing with your ESA is to create a written request that notifies the landlord, property manager, or association (for condominiums) of your disability.

Also, your request needs to be accompanied by a letter from a licensed medical practitioner specifying the need for the emotional support animal. This letter helps demonstrate your disability, and that your landlord has the right to ask for this piece of documentation. Let’s say that you are receiving medical treatment for depression. Your physician will be specifying in the letter that your emotional support animal offers you the assistance you need to perform even the most basic activities of daily living.

Landlords, property managers, and homeowners associations need to realize that not all disabilities are obvious. Emotional support animals usually cater to people with disabilities that are psychological and emotional in nature. The absence of signs of disability does not imply that a request made by the individual can be denied.

What If Your Request Is Denied?

Once the association receives your letter request and they evaluate it, they can now decide whether to approve or disapprove your request.

What should you do if, in case, they deny your request? You may then file a complaint with state agencies. They will review your complaint to determine whether the reason for the disapproval of your request is discrimination. If there is indeed discrimination, you can file a lawsuit against the association. On the other hand, the association will need to explain why they denied your reasonable request.

The Abuse of “Emotional Support” Animals

While emotional support animals help people with disabilities by providing companionship and assistance, many people tend to abuse their use. There are travel restrictions for animals, and this alone has led to the increase in the number of people claiming to have a disability so they can travel with their “emotional support” animal without extra fees.

Because when it comes to traveling, airlines require an ESA letter issued by a physician within the same year of travel. It would help to find out what an airline’s expectations are. It was recently announced that Delta and American Airlines now require additional documentation from ESA owners. They now do this to keep fake ESA owners at bay.

A housing provider is prohibited from:

  • Demanding a pet deposit or any additional deposit related to the assistance animal specifically.
  • Demanding pet rent.
  • Restricting the areas of the housing complex where a service animal may access. However, an emotional support animal’s access may be limited to the housing domicile interior and be prohibited in common areas and outdoor areas (such as the pool area or barbecue area) that other tenants also use. Once again, Service Animals have additional access rights that Emotional Support Animals do not.

A landlord or property manager can only allow service animals and emotional support animals to live with its owner in a housing.

Mississippi bill permits veterans to bring service dogs with them in public places

Veterans are known to often suffer post-traumatic stress disorder or PTSD. These individuals can benefit from the companion of service animals so that they can cope better. Although service animals are usually used for people with visual and hearing problems, a Mississippi house bill wants to include veterans on the list of individuals who are allowed to carry service animals with them in public places.

The abovementioned House Bill 944 has already passed the House. The Senate Public Health and Welfare Committee are still yet to take action. Rep. Tommy Reynolds, D-Charleston, states that the bill is something that is needed by every veteran with PTSD.

If you don’t know what PTSD is, it’s an anxiety disorder that affects people who have been exposed to a traumatic event. It can be that the person experienced the event himself or just witnessed the event.

The Department of Veterans Affairs mentions that there isn’t a lot of research to prove that service animals such as dogs can treat PTSD. However, they mention that service dogs have benefits for veterans. Dogs serve as loyal companions, reduce stress, promote socialization, and are fun and lovable to be with.

Trainer of service dogs was denied service at a local pizza shop

Susan Napier, a trainer of service dogs, was not allowed to dine at a local pizzeria, Broadway Pizza, in the Orlando area. Napier said that she brought her service dog with her. As soon as the pizzeria’s manager saw them, he immediately asked them to leave. According to Napier, the manager said that he didn’t care about the American Disabilities Act and that he didn’t have to follow it. 

Napier left but made sure to share the incident with her Facebook friends. Her post garnered 225 shares and comments. She also told News 6.

The following morning, Friday, Napier reached out to the corporate owner of the pizzeria. Someone named Rosalie came to apologize for what had happened and even sent out a memo to all stores stating that the incident was unacceptable. Rosalie also emphasized the importance of the ADA laws.

On Friday night, Napier, together with a colleague, went back to Broadway Pizza to check whether they implemented the ADA laws. She said that she was now able to access the restaurant and get a table.
